The West Virginia State legislature has passed significant tort reform provisions to alleviate mounting concerns. Provisions included: capping non-economic damages at $250,000 per occurrence; capping all trauma damages at $500,000; individual liability equal to the percent of fault; and the creation of physician funding to help establish a medical trust fund, acting as a reserve pool that physicians can access for liability insurance costs.
