Ohio Supreme Court Overturns $30 Million award |

On Thursday, the OSC threw out the $30 million verdict in the Hollins case. Hollins won the $30 million during a trial that took place in 2004. The OSC threw out the $30 million verdict citing the plaintiff’s attorney in the case for courtroom misconduct that affected the outcome. The verdict was Ohio’s largest medical malpractice award, however, it was influenced by passion and tainted by the plaintiff attorney’s inappropriate behavior, Justice Terrance O’Donnell wrote in the OSC’s 6-1 opinion. The OSC court agreed with the retired judge involved in the case and the 8th Ohio District Court of Appeals, that the damages were excessive. Based upon the OSC opinion, the case will now have to be retried. The AMCNO is pleased that this verdict has been overturned and with the opinion of the Ohio Supreme Court in this matter. |
